Morse, P.A., MIB Solutions, Inc. or any of their affiliates or agents be responsible for any indirect, special, incidental, consequential or similar damages, including damages for lost data or profits, to any person or enttity regardless of the legal theory, even if such party has been advised of the possibility of such damage and even if arising from a fundamental breach of this agreement. Further, in no event shall Harvey E. Morse, P.A., MIB Soluctions, Inc., or any of their affiliates be responsible for damages which exceed the total of all fees paid by subscriber to Harvey E. Morse, P.A., or any of their affiliates under this agreement.
